How to Identify Malaysia Tax Resident Status

Many people assume that being a Malaysian citizen automatically means they are a tax resident.
In reality, this is a common misconception.
Under the Malaysian tax system, tax resident status is determined based on an individual’s period of stay in Malaysia.
This means that:

  • Malaysian citizens may not necessarily be tax residents
  • Foreign individuals may qualify as Malaysian tax residents

An individual will be regarded as a Malaysian tax resident if any one of the following four conditions is fulfilled.

1.Staying in Malaysia for 182 days or more
If an individual stays in Malaysia for 182 days or more in a year of assessment, the individual will be considered a tax resident.

2.Stay of less than 182 days but connected with the preceding or following year
If the stay in a particular year is less than 182 days, but the period of stay is linked to the preceding or following year, and the total consecutive period exceeds 182 days, the individual may still qualify as a tax resident.

Temporary absences may still be treated as part of the continuous stay, such as:

  • Work-related assignments
  • Studies or education
  • Medical treatment
  • Short overseas holidays
  • Visiting relatives (not exceeding 14 days)

As long as the stay before and after the absence remains continuous, these days may still be counted as days in Malaysia.

3.Stay of 90 days with qualifying conditions in previous years
An individual will also qualify as a tax resident if:

  • They stay in Malaysia for at least 90 days in the current year, and
  • In the four preceding years, the individual has for at least three years:
  • been a Malaysian tax resident, or stayed in Malaysia for more than 90 days.

4.No stay in the current year but resident in surrounding years
An individual may still be regarded as a tax resident if:

  • They did not stay in Malaysia in the current year, but
  • They were tax residents in the three preceding years, and
  • They are also a tax resident in the following year.

Tax Resident vs Non-Resident

Tax Resident

  • Progressive tax rate: 0% – 30%
  • Eligible for Tax Relief
  • Eligible for Tax Rebate

Non-Resident

  • Flat tax rate: 30%
  • Not eligible for tax relief or tax rebate
