This fundamental expansion ensures that contributing employees are safeguarded against accidental injuries at all times, securing employee well-being and providing a more encompassing social security protection.
The Non-Employment Accident Injury Scheme is the core legislative instrument facilitating this expansion:
- Expanded Scope: The scheme provides protection against personal injuries sustained by an employee during their non-working hours.
- Definition: A “Non-Employment Injury” is defined as a personal injury caused by an accident that did not arise out of and in the course of the employee’s employment.
- Practical Application: This extends the safety net to activities such as leisure, running personal errands, or rest periods, ensuring protection regardless of time or location.
A key principle of the new framework is the guarantee of parity in benefits. If a covered employee becomes disabled due to a Non-Employment Injury, they are entitled to receive all the same benefits as those awarded under the traditional Employment Injury Scheme.
These benefits, calculated under the revised terms of the Fourth Schedule of Act 4, include:
- Physical Rehabilitation Support
- Temporary Disablement Benefit (TDB)
- Permanent Total Disablement Benefit (PTDB)
- Survivors’ Benefits (Dependants’ Benefit)
This guarantees that the level of financial and physical support remains consistent across both work-related and non-work-related accidental injuries.
